These Terms of Use govern access to and use of Bequestor. By using Bequestor, creating an account, accepting an invitation, entering information, downloading a record, or otherwise accessing the service, users agree to these terms.
Bequestor is designed to support estate planning firms and their clients by providing a structured way to organize personal belongings, legacy wishes, notes, photos, and related information. Bequestor is a reference and organization tool and should be used alongside, not in place of, formal estate planning documents.
Purpose of the Service
Bequestor helps users create and maintain an organized legacy record of personal belongings, intended beneficiaries, item details, locations, notes, photographs, and related instructions.
The service is intended to support clarity and communication in the estate planning process. It does not create, amend, replace, revoke, or interpret any will, trust, codicil, memorandum, beneficiary designation, power of attorney, or other legal document.
No Legal Advice
Bequestor does not provide legal, tax, financial, fiduciary, or estate planning advice. Information, prompts, labels, fields, examples, or records generated through Bequestor are provided for organization and reference only.
Users should consult a qualified attorney or other appropriate professional regarding wills, trusts, estate planning documents, legal rights, tax implications, beneficiary designations, fiduciary duties, and the legal effect of any information entered into Bequestor.
Relationship to Estate Planning Firms
Bequestor may be offered to clients through an estate planning firm. When a client is invited by a firm, the firm retains read-only access to the client’s Bequestor record for reference as part of the planning process.
Bequestor does not create an attorney-client relationship between Bequestor and any user. Any attorney-client relationship exists only between the client and the client’s attorney or law firm, if applicable.
User Accounts and Access
Users are responsible for maintaining the confidentiality of their login credentials and for all activity that occurs through their account.
Users agree to provide accurate account information and to update that information when necessary. Users should not share login credentials with unauthorized individuals or attempt to access records, accounts, or information they are not authorized to view.
Client Responsibility for Information
Clients are responsible for the information they enter into Bequestor, including the accuracy, completeness, and continued relevance of belongings, notes, locations, intended beneficiaries, percentages, instructions, and other record details.
Bequestor provides a structure for organizing information, but does not verify, guarantee, or determine the completeness, accuracy, legal validity, enforceability, or legal effect of any information entered by a user.
Use of Records
Bequestor records are intended to serve as an organized reference for clients, estate planning firms, executors, trusted advisors, and other individuals the client chooses to involve.
A Bequestor record should not be treated as a legally binding instruction unless an attorney determines that the information has been properly incorporated into legally effective estate planning documents or other appropriate legal instruments.
Downloaded and Shared Records
Bequestor allows users to download or print a read-only version of a legacy record. Once a record is downloaded, printed, emailed, saved externally, or otherwise shared outside Bequestor, the user is responsible for how that copy is stored, protected, distributed, and used.
Users should take care when sharing downloaded records because they may contain sensitive personal, family, financial, or estate planning information.
Appropriate Use
Users agree to use Bequestor only for lawful purposes and in a manner consistent with these terms. Users may not misuse the service, interfere with its operation, attempt unauthorized access, upload harmful code, or use Bequestor to store or transmit unlawful, abusive, fraudulent, or intentionally misleading information.
Users should not use Bequestor to store passwords, full account numbers, private keys, access credentials, or other highly sensitive information that could create risk if viewed by another person.
Privacy and Data Handling
Use of Bequestor is also governed by the Privacy Policy. The Privacy Policy explains how information may be collected, used, accessed, and protected.
Users should review the Privacy Policy carefully, especially because Bequestor records may include sensitive personal and family information.
Service Availability and Changes
Bequestor aims to provide reliable access to the service, but uninterrupted or error-free availability cannot be guaranteed. Access may be affected by maintenance, updates, technical issues, third-party service providers, security needs, or circumstances outside Bequestor’s control.
Bequestor may update, modify, suspend, or discontinue portions of the service as needed to improve functionality, address security or operational concerns, or adapt to future business or legal requirements.
Third-Party Services
Bequestor may rely on third-party providers for hosting, storage, security, communication, payment processing, analytics, or other operational support. Bequestor is not responsible for failures, interruptions, or actions of third-party services outside its reasonable control.
Intellectual Property
Bequestor, including its name, design, structure, branding, software, page layouts, text, and related materials, is owned by Bequestor or its licensors and is protected by applicable intellectual property laws.
Users may use Bequestor only as permitted through the service. Users may not copy, reproduce, reverse engineer, resell, or commercially exploit Bequestor except as expressly authorized.
User Content
Users retain responsibility for the information, photos, notes, and other content they enter into Bequestor. By entering content, users confirm that they have the right to provide and use that content within the service.
Users grant Bequestor the limited permission necessary to store, process, display, generate, and maintain that content solely for the purpose of operating the service and providing the requested recordkeeping functions.
Disclaimers
Bequestor is provided as an organizational and reference tool. Bequestor does not guarantee that use of the service will prevent family disagreement, estate disputes, misunderstanding, loss, or other adverse outcomes.
Bequestor does not guarantee that a record will be legally enforceable, complete, current, or consistent with a user’s estate planning documents. Users are responsible for reviewing their records with appropriate professionals when legal, tax, financial, or fiduciary consequences may be involved.
Limitation of Liability
To the fullest extent permitted by law, Bequestor is not liable for damages arising from or related to use of the service, inability to access the service, reliance on information entered into the service, downloaded or shared records, user error, unauthorized access, loss of data, service interruption, or decisions made based on a Bequestor record.
This limitation applies to direct, indirect, incidental, consequential, special, exemplary, or punitive damages, whether based on contract, tort, negligence, strict liability, or any other legal theory, to the extent permitted by applicable law.
Indemnification
Users agree to be responsible for claims, losses, liabilities, damages, costs, or expenses arising from their misuse of Bequestor, violation of these terms, unauthorized sharing of records, inaccurate information entered into the service, or violation of another person’s rights.
Account Suspension or Termination
Bequestor may suspend or restrict access to the service if an account is used in violation of these terms, creates security risk, appears fraudulent, or otherwise threatens the integrity or operation of the service.
Changes to These Terms
Bequestor may update these Terms of Use from time to time as the service develops or as legal, operational, or security needs change. Updates will be posted on this page. Continued use of Bequestor after updated terms are posted constitutes acceptance of the updated terms.
